Principles that apply to duties

Principles that apply to all persons holding a duty under the Model Work Health and Safety Act (Model Act) include:

  • Duties are non-transferable.

  • A person can have more than one duty at any time.

  • More than one person can concurrently have the same duty and each must comply with their duty.

  • Health and safety duties require management of risk.
