Abstract:
An 85-year-old lady has been killed violently with a blunt murder weapon while in bed wearing her nightdress. The appellant was tried and convicted for her murder. The High Court of Australia (HCA) unanimously quashed the appellant's conviction and ordered that a verdict of acquittal be entered. The HCA found that the Crown case concerning opportunity and motive was extremely weak.
