Abstract:
The Federal Circuit Court of Australia Full Court (FCAFC) has denied the application of Mondelez Australia Pty Ltd for declaratory relief concerning the manner of calculation of the entitlement to paid personal/carer's leave. The FCAFC found that the respondents, the two Tasmanian Cadbury workers, were each entitled to accrue 10 days of paid personal/carer's leave for each year of service and that the respondents' entitlement was an entitlement to be absent from work for a portion of the 24-hour period that would otherwise be allotted to work.
