Abstract:
The New South Wales Supreme Court (NSWSC) has set aside the subpoena and the notice to produce documents issued by Bianca Rinehart, trustee for The Hope Margaret Hancock Trust, to access the books and records of Hancock Prospecting Pty Ltd in relation to allegations of oppressive conduct. The NSWSC found that the mere fact that Ms Rinehart had sought the production of documents going to the same issue as the documents previously sought necessarily amounted to an abuse of process and involved a fishing expedition without a legitimate forensic purpose.
