R V Fairclough

Supreme Court of the Australian Capital Territory

Judgment Date:
2019-08-19

Abstract:
The man charged over the Belconnen stabbing was denied of his application to withdraw his guilty pleas on all the charges against him. The Supreme Court of Australian Capital Territory (ACTSC) found that the guilty pleas were entered by the accused with the sufficient knowledge of the relevant facts and law, such that the integrity of the pleas was not demonstrated to have been impugned. The ACTSC found that the accused has not established any reason why he should be permitted to withdraw guilty pleas.
