Abstract: The New South Wales Supreme Court (NSWSC) answered the question posed to it for determination in the affirmative, as to whether the applicant has established the publication element of the cause of action of the defamation case against respondents media companies, in respect of each of the Facebook comments made by the respondents' third-party users. The NSWSC found, on balance of probabilities, that the respondents were the first or primary publishers, in relation to the general readership of Facebook page the respondents have operated and that each of the respondents have each participated in the publication of the disputed comments.
