Abstract:
The Federal Court of Australia (FCA) has determined that Dunlop Aircraft Tyres Limited and its subsidiaries (Dunlop) did not infringe restrict Goodyear Tire & Rubber Company's (Goodyear) registered 'DUNLOP' and 'Flying D Logo' trade marks. However, the FCA affirmed the Registrar of Trade Marks' decision upholding Goodyear's opposition to Dunlop's trade marks registration, and therefore Dunlup would not be able to pursue its trade mark applications.
