Abstract:
The High Court of Australia has allowed in part an appeal from the decision of the Supreme Court of South Australia Court of Criminal Appeal Full Court concerning sentencing of an offender under (SA) Criminal Law Consolidation Act 1935 s 50(1). A majority of the court held that the sentencing judge should have exercised discretion to ask the jury, after the general verdict of guilty was returned, to specify which of the alleged acts of sexual exploitation they agreed had been proved.
