Abstract:
The majority of the High Court of Australia has found that the Federal Court of Australia Full Court was correct to conclude that there was a substantial question as to whether the debt on which Ramsay Health Care Australia Pty Ltd relied was owing and that the FCA, as the Bankruptcy Court, should proceed to investigate this question in order to decide whether it was open to it to make a sequestration order.
