Abstract:
The Federal Court of Australia (FCA) has approved the settlement reached by a 15-years-old's litigation representative and his school, concerning a proceeding for unlawful discrimination. The FCA considered the opinion of an independent counsel, that the offer made by the school was fair and reasonable and that acceptance of it was in the minor's best interests both in the context of the litigation and also in relation to the minor's ongoing needs for the future, including the provision of certainty for the minor and his family.
