The Federal Court of Australia (FCA) has determined questions arising from the winding up of companies in liquidation. The FCA has found that the companies' subordination documents did not constitute an enforceable debt subordination agreement but would constitute as relevant declarations for purposes of (CTH) Corporations Act 2001 s 563C.
