Abstract:
The New South Wales Supreme Court (NSWSC) has dismissed an appeal by a vehicle owner who was involved in a collision with respondent. The NSWSC found that while the vehicle of the owner is being repaired, he should only be entitled to damages which represent the market rate of hiring a replacement car which would reasonably meet his needs rather than the cost of an equivalent vehicle.
