Abstract:
The High Court of Australia (HCA) has made the determination on the validity of (VIC) Corrections Act 1986 s 74AB. The HCA found that s 74AB did no more than alter the conditions to be met before the applicant could be released on parole and neither the substantive operation nor the practical effect of s 74AB was to impose any punishment on the applicant.
