Abstract:
The New South Wales Supreme Court of Appeal (NSWCA) has dismissed the appeal of the State of NSW against the decision of the NSW District Court permitting a driver involved in a fatal car crash who was referred to as 'criminal' in a press statement to amend his pleading to adopt contextual imputations. The NSWCA held that not every prior conviction would be regarded as necessarily warranting that label and that evidence of other convictions of the driver was not conclusive evidence of the truth of the imputation that he was a 'criminal'.
