Abstract:
The Supreme Court of Australian Capital Territory (ACTSC) has granted the application of Mental Health Australia Ltd (MHA) for judicial review against the decision of the Registrar of the ACT Long Service Leave Authority requiring it to be registered under (ACT) Long Service Leave (Portable Schemes) Act 2009. The ACTSC found that the decision to require MHA to register as employer under the Act was based on error of law.
