Abstract:
The owners of the yacht "Monster Project", was denied of their application for stay of the sale of the yacht. The Federal Court of Australia (FCA) was unable to see any basis upon which the stay should be granted and found that there was no proper basis on which the interests of all of the creditors who have claims against the yacht would be protected if the FCA would interfere with the sale process by staying the sale or failing to allow the Admiralty Marshal to give effect to the bid, that should realise the highest price offered by 10 persons who were interested to bid on the yacht.
