Abstract: The Federal Court of Australia Full Court (FCAFC) has confirmed that refurbishing printer ink cartridges could result in patent infringement. The FCAFC found that the modifications made by a manufacturer of generic printer consumables constituted a repurposing of the cartridges which amounted to 'remaking' the invention. As such, it infringed the patents of Seiko Epson Corporation by importation and sale of printer cartridges which had been modified for re-use.
