Lim V Comcare

Federal Court of Australia

Judgment Date:
2019-06-25

Abstract:
The Federal Court of Australia Full Court (FCAFC) has dismissed the appeal against the decision of the Administrative Appeals Tribunal (AAT) declining appellant's claim for compensation that has stemmed from the psychological condition the appellant has sustained during her employment. The FCAFC found that none of the appellant's grounds of appeal has established that the AAT has committed error of law and that the decision of the AAT was plainly open on evidence and even if the decision was wrong, it was not a decision that the FCAFC could set aside on the appeal commenced under the (CTH) Administrative Appeals Tribunal Act 1975 s 44(1).
