Abstract:
The Queensland Supreme Court (QSC) has refused the application of a joint venture (JV) partner for exploitation of coal deposit to adduce new expert evidence to supplement case for breach of JV agreement. The QSC found that the applicants had been previously granted a very significant indulgence of permitting them to reshape their case according to a newly obtained expert opinion evidence shortly before the trial was due to commence that resulted to additional burden on the respondents.
