Director of Public Prosecutions (Dpp) Reference No 1 of 2017

High Court of Australia

Judgment Date:
2019-03-20

Abstract:
The High Court of Australia (HCA) has unanimously allowed an appeal from a decision of the Supreme Court of Victoria Court of Appeal answering the point of law raised for consideration pursuant to (VIC) Criminal Procedure Act 2009 s 308. The HCA found that the direction commonly referred to as the 'Prasad direction' was contrary to law and should not be administered to a jury determining a criminal trial between the Crown and an accused person.
