Abstract: A man's appeal against his conviction of indecently dealing with a child under 13-years-old has been allowed by the High Court of Australia (HCA). The complainant admitted telling lies to the police, the officers of the Department of Family and Children's Services, and the appellant. The HCA found that the misdirection precluded the jury from adopting a process of reasoning, favourable to the appellant, that was open to it and ordered that there be a new trial.
