Abstract: A protestor has harnessed himself to a ship loader at a coal terminal thereby causing the machine to continue to be inoperable for approximately two hours. The High Court of Australia, by majority, quashed the protestor's conviction for offence of intentionally or recklessly destroying or damaging property belonging to another and found that damage to property within the meaning of the (NSW) Crimes Act 1900 s 195(1) required proof that a person's act or omission has occasioned some alteration to the physical integrity of the property.
