Abstract:
The Federal Court of Australia (FCA) has upheld the decision of the Federal Circuit Court of Australia (FCCA) in an extradition proceeding that a national of Venezuela was eligible for surrender to the United States of America. The FCA found that the FCCA was correct in the analysis and understanding of dual criminality and that the conduct of the Venezuelan national which constituted the offence was sufficient for the purpose of making a finding of eligibility for surrender.
