Abstract:
The New South Wales Court of Criminal Appeal (NSWCCA) has allowed an appeal of a man who was convicted for manufacturing a commercial quantity of methylamphetamine. The NSWCA has substituted a verdict for knowingly taking part in manufacture of commercial quantity of methylamphetamine. It was decided that in order to be guilty of the offence of manufacturing of prohibited drug, one must have actually produced the prohibited substance.
