Abstract: The High Court of Australia (HCA) has unanimously allowed an appeal against the decision of the Supreme Court of Nauru. The HCA found that the decision of the Refugee Status Review Tribunal (RSRT) to proceed and to decide the matter without making any enquiry about the appellant's absence on the date of the hearing was legally unreasonable. The HCA ordered that the decision of the RSRT be quashed and the matter be remitted to the RSRT for reconsideration according to law.
