Abstract:
The Australian patents of a catheter insertion device has been revoked upon its patentee's cross-claim application of infringement case against another insertion device being sold around the country. The Federal Court of Australia ruled that the respondent's catheter insertion device of invention was not designed to allow for controlled release of blood in the way that applicant's device was.
