The High Court of Australia (HCA) has allowed an appeal against the decision of the Federal Court of Australia Full Court (FCAFC), which set aside the permanent stay of proceedings before the FCA. The HCA held that the 'timely, cost effective and efficient conduct of modern civil litigation takes into account wider public interests than those of the parties to the dispute'.
