Abstract:
The High Court of Australia (HCA) has unanimously allowed the appeal against the decision of Court of Appeal of the Supreme Court of Western Australia (WASCA) that convicted appellant of possession of prohibited drug, namely cannabis, with intent to sell or supply to another. The HCA found that majority of WASCA erred in finding that fresh evidence did not give rise to a significant possibility of acquittal by the jury.
