Abstract:
The High Court of Australia (HCA) has unanimously dismissed the appeal of a Sri Lankan national who claimed fear of persecution on the basis of cruel, inhuman or degrading treatment if he returned to Sri Lanka. The HCA found that the Refugee Status Review Tribunal was apprised of the matters regarding prison conditions which the appellant raised and considered them in determining whether complementary protection was owed to him.
