Abstract:
The High Court of Australia (HCA) has allowed the appeal of a person who had been denied procedural fairness and possibility of a successful outcome on his opposition against the grant of probate. The HCA unanimously ordered for a new trial after finding that there was sufficient interest which would be affected by the probate.
