Abstract:
The High Court of Australia (HCA) has dismissed the appeal by a visa applicant, against the decision of the Federal Court of Australia Full Court (FCAFC). The HCA found that 'although ultimately correct in the result, the majority in the FCAFC was wrong to distinguish between a decision involving a jurisdictional error and a decision wanting in authority'. The HCA found while there was an error of law on the part of the Administrative Appeals Tribunal, such did not amount into a jurisdictional error.
