Abstract:
The Federal Court of Australia (FCA) has determined a defamation proceedings commenced by a property developer, against the publisher and the author of a news article (the respondents) titled 'Developers offer stamp duty discounts as off-the-plan apartment sales slow'. The FCA entered judgment in favor of the respondents and found that the imputations were not reasonably capable of being defamatory of the applicant.
