Abstract:
The Federal Court of Australia Full Court (FCAFC) has allowed the appeal by an unlicensed second-hand car seller for violation of (CTH) Australian Securities and Investments Commission Act 2001 s 12CB(1). The FCAFC upheld the breach of credit but declined to call the appellant's conduct to be unconscionable. The FCAFC established that the appellant presented sufficient evidence by records of books of accounts which were not made basis by respondent in deciding the unconscionable conduct case.
