Abstract:
The New South Wales Supreme Court (NSWSC) has determined that a public servant, employed as a senior investigator within the NSW Fair Trading, was authorised to prosecute offences under (NSW) Crimes Act 1900 in relation to the deceptive conduct of a migration agent. The NSWSC likewise refused the migration agent's application to have the question on the senior investigator's authority be separately determined by the NSW Court of Appeal, on basis among others, that no special circumstances existed which would have made removal desirable.
