Abstract:
The High Court of Australia (HCA) has set aside the order of the Supreme Court of Victoria Court of Appeal (VSCA) which quashed a man's conviction for murder and ordered its retrial on ground of miscarriage of justice. The HCA held that the trial judge's directions to jury as to issue of proof of reasonable doubt have not caused the jury to be misled and be left in any uncertainty as to the true meaning of the need for proof beyond reasonable doubt.
