The applicant, a multi-million fashion retail brand companym, has been successful in recovering payments made to another fashion retail brand company pursuant to the (CTH) Corporations Act 2001 ss 588FA, 588FE and 588FF. The Federal Court of Australia found that the elements of the applicant's claim under the Act were satisfied and properly pleaded in the applicant's originating process.
