Abstract: The New South Wales Supreme Court of Criminal Appeal (NSWCCA) has found that there was no factual basis for the application of the (NSW) Crimes (Sentencing Procedure) Act 1999 s 47(2)(b) and the sentencing hearing had been tainted by procedural irregularity when the NSW District Court (NSWDC) set the commencement date for the sentence as an unspecified future date.
