Abstract:
The Federal Court of Australia (FCA) has determined that the petroleum exploration permits granted within the native title determination area did not affect or preclude the intended use or other uses of such determination area. The FCA found that the exploration for petroleum was not a particular purpose within the meaning of the (CTH) Native Title Act 1993 s 47B(1)(b)(ii) and, accordingly, s 47B was applicable.
