Abstract:
The Chief of Defence Force has been successful in his appeal against the setting aside of Federal Court of Australia's (FCA) termination of respondent's service as Australian Defence Force (ADF) officer because of his free exercise of religion and political communication through social media. The FCA Full Court found that there was a rational connection between the terms of (CTH) Defence (Personnel) Regulations 2002 reg 85 and the overall purpose of the Defence (Personnel) Regulations, to enable control of the membership of the ADF.
